
CHAMPION, MICH., June 4, 2014 — Yesterday Eagle Mine provided oral arguments before the Michigan Court of Appeals in contested case petitions challenging our Part 632 mining permit and the Part 31 groundwater discharge permit. These cases date back to 2007, and were filed by a group of plaintiffs against the Michigan Department of Environmental Quality (MDEQ) and Eagle Mine.
In 2010, the permits were affirmed and the plaintiffs filed an appeal. Two separate state circuit court rulings in late 2011 and early 2012 affirmed MDEQ’s decision to issue the permits, which was appealed by petitioners to the Michigan Court of Appeals.
The Michigan Court of Appeals did not render a decision today. However, we are confident in our position and optimistic of the final court decision. Click here for our official statement.
